This Privacy Policy is a part of our Terms of Service. By visiting www.mypalife.org and using this site and our online store, you are consenting to our privacy policy and agree to comply with this Privacy Policy and our Terms of Service.

myPA Life is committed to protecting your privacy online. This Privacy Policy describes the personal information we collect through this website at www.mypalife.org (the “Site”), and how we collect and use that information.

 

The terms “we,” “us,” and “our” refers to myPA Life. The terms “user,” “you,” and “your” refer to site visitors, customers, and any other users of the site. The term “personal information” is defined as information that you voluntarily provide to us that personally identifies you and/or your contact information, such as your name, phone number, and email address.

Use of myPA Life, including all materials presented herein and all online services provided by myPA Life, is subject to the following Privacy Policy. This Privacy Policy applies to all site visitors, customers, and all other users of the site. By using the Site or Service, you agree to this Privacy Policy, without modification, and acknowledge reading it.

INFORMATION WE COLLECT

When you visit our site, some information is automatically or passively collected. This may include information such as the Operating System running on your device, Internet Protocol address (which may be used to obtain your geolocation), access times, browser type, and language, and the website you visited before our site. We also collect information about how you use our site, including the elements you have interacted with, metadata and other details about these elements, change states, and other user actions. If we directly combine any information gathered through passive means with personal information, we treat the combined information as personal information under our Privacy Policy. Otherwise, we use information collected by passive means in aggregated forms further discussed in the Disclosures section.

 

When you purchase something from our site, we collect the personal information you voluntarily provide us which may include your name, address, email address, phone number, and order history. We also use cookies, web beacons, or other tools that collect information and make it easier to use our site in order to:

The information you provide is used to process transactions, send periodic emails, and improve the service we provide. We do share your information with trusted third parties who assist us in operating our website, conducting our business and servicing clients and visitors. These trusted third parties agree to keep this information confidential. Your personal information will never be shared with unrelated third parties. 

INFORMATION WE DO NOT COLLECT

We do not knowingly solicit or collect individually identifiable health information about any patients of any health care providers. As a health care provider or other individual involved in health care, you or information you obtain may be subject to the Health Insurance Portability and Accountability Act and the regulations promulgated thereunder (“HIPAA”) and other state or federal laws governing the privacy and security of individually identifiable patient information. You should consider HIPAA and other applicable state and federal laws when using our Site(s) and Services, and we strongly discourage the disclosure or release of any individually identifiable health information about patients on our Site(s) or in relation to our Services.

EMAIL MARKETING

By providing us with your email address, you are giving permission to send you emails about our store, new products, and other updates. You have the opportunity to unsubscribe from these emails at any time by clicking the “Unsubscribe” button included at the bottom of each email.

ACTIVITY

We may record information relating to your use of the Site, such as the searches you undertake, the pages you view, your browser type, IP address, requested URL, referring URL, and timestamp information. We use this type of information to administer the Site and provide the highest possible level of service to you. We also use this information in the aggregate to perform statistical analyses of user behavior and characteristics in order to measure interest in and use of the various areas of the Site.

We may send cookies to your computer in order to uniquely identify your browser and improve the quality of our service. The term “cookies” refers to small pieces of information that a website sends to your computer’s hard drive while you are viewing the Site. We may use both session cookies (which expire once you close your browser) and persistent cookies (which stay on your computer until you delete them). The Site does not respond to Do Not Track signals sent by your browser.

Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you on our Site. Other sites accessible through our site via links or otherwise have their own policies in regard to privacy. We are not responsible for the privacy policies or practices of third parties. If you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

DISCLOSURES

We do not share your personal information with third parties without your consent other than with the following:

 

  • Publication of Information for Membership Directories and Registration Lists. As a professional organization, certain of the information you provide may be published on the Site and in print or digital form in a variety of ways to allow other physician assistants and the public to find you, including, but not limited to, in directories, membership lists, and other types of registration lists and events (“Directory Lists”). Directory Lists will not include sensitive information, such as credit card or bank information, or social security numbers.

  • Fulfillment of Service Requests with our Business Partners or Affiliates. myPA Life may share information with our business partners to fulfill services provided to you, for legislative and regulatory purposes, and/or to provide our business partners an opportunity to offer products or services that may be of interest to you. Also, myPA Life may share personal information when we engage service providers and other companies to provide limited services to us or on our behalf including, but not limited to, packaging; mailing and delivering promotional offers, sweepstakes or contests; answering customer questions about products or services; consulting services; data modeling; printing; sending postal mail; processing event registration; processing payment; and organizing events, and may share information about you with those entities.

  • Third Party Service Providers. With third parties who work on our behalf, provided that such third parties provide at least the same level of privacy protection as required by this Privacy Policy and for no other purpose than to provide us with necessary services.

  • Lawful Requests. To comply with laws or to respond to lawful requests and legal process. We will attempt to notify you at the address provided if we have received a lawful request for your information.

  • Protection of Rights and Property. To protect the rights, property, or safety of myPA Life, LLC, our agents, customers, or the general public including to enforce our agreements, policies and terms included in this Privacy Policy or our Terms of Service, and protect ourselves and our services from fraudulent, abusive, or unlawful uses; investigate and defend ourselves against third-party claims or allegations; or assist government enforcement agencies.

  • Corporate Restructuring. For the purposes of a business deal (or negotiation of a business deal) involving a sale or transfer of all or a part of our business or assets. Business deals may include any merger, financing, acquisition, divestiture or dissolution transaction or proceeding. In the event of an insolvency, bankruptcy, or receivership, personal information may also be transferred as a business asset. If another company acquires our company, business or assets, that company will also acquire and possess the personal information collected by us and will assume the rights and obligations regarding your personal information as described in this Policy.

  • Aggregate Information. We may share aggregated information with clients, prospective clients, partners or the press to demonstrate usage of a service, identify industry and advertising trends, and to generate publicity for myPA Life, LLC.

CUSTOMER CHOICE

You may choose not to provide us with personal information. You may also, at any time, access your personal information to update, correct, or delete certain personal information about you by contacting us at info@mypalife.org. You may also decide not to opt–in to receive marketing information from myPA Life. Please be aware that even if you update or remove personal information that you have provided to us, your personal information may be retained in our backup files and archives for a reasonable period for legal purposes.

COMMUNICATIONS AND UNSOLICITED MARKETING

If you opted in to receive communications from us, we may send you administrative messages and updates regarding your account, updates regarding the Site, and, where permitted by applicable law, information regarding our offers, products and services, including, without limitation, through social media updates, by email and postal mail. If you no longer want to receive commercial email messages, you may indicate your preferences regarding commercial email messages by taking the steps described in such messages. ANALYTICS

We may use Google Analytics to analyze User use of our Site. Google Analytics provides aggregated data to help us make informed business decisions. Google, as a third party, controls information collected through Google Analytics. Information about Google’s privacy practices with respect to Google Analytics should be reviewed prior to using the Site. 

E-COMMERCE

If you choose a direct payment gateway to complete your online purchase, the payment gateway stores your credit card or account data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After purchase, your transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, a joint effort of brands such as Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our online store and its service providers.

SECURITY

We maintain security measures to protect your personal information from unauthorized access, misuse, or disclosure. However, no exchange of data over the Internet can be guaranteed as 100% secure. While we make every effort to protect your personal information shared with us through our Site, you acknowledge that the personal information you voluntarily share with us through this Site could be accessed or tampered with by a third party. You agree that we are not responsible for any intercepted information shared through our Site without our knowledge or permission. Additionally, you release us from any and all claims arising out of or related to the use of such intercepted information in any unauthorized manner.

U.S. LAW

The Site is designed for use by individuals in the United States, and information collected from visitors to the Site will be processed in the United States and other jurisdictions. Users from other countries are advised that by their use of the Sites and their disclosure of personal information, their personal information will be transferred to, and stored and processed in, the United States, which may have different data protection laws than their country. Personal information we collect, including through the Site and Services, may be used and disclosed as permitted by United States law, including to law enforcement and/or national security authorities. It is up to you to determine whether accessing this site and purchasing our products and services are legal where you are located. You access this Site and purchase our products and services at your own risk, and you are responsible for compliance with all applicable laws, rules, regulations and treaties.

CHILDREN

The Site is for a general adult audience and is not intended for use by or targeted to children. We do not knowingly collect personal information from children. To access or use the Site, you must be 18 years or older and have the requisite power and authority to enter into this Privacy Policy. Children under the age of 18 are prohibited from using the Site or the Service.

VISITORS GDPR RIGHTS

According to the GDPR a “data subject” is defined as an identifiable natural person. A natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as: a name, an identification number, location data, or online identifier. Alternatively, they may be identified by reference to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.   • You have the right to be informed with respect to your personally identifiable information (PII) retained by the Company. As such, you may request access to your data that the Company stores and the rights to either correct or erase your personal data.

  • We will retain any personally identifiable information you choose to provide to us unless: (a) you request for us to delete the information, (b) we stop using our existing data providers, or (c) at Company’s discretion, we decide to remove the data.

  • You have the right to seek restrictions on the processing of your data.

  • You have the right to object to the processing of your data and the right to the portability of your data.

  • You have the right to withdraw consent provided to the Company concerning the processing of your personal data, as well as the right to withdraw that consent at any time, without affecting the lawfulness of processing based upon consent that occurred prior to your withdrawal of consent.

  • You have the right to not be subjected to automated decision-making via pre-ticked boxes, additions to our email marketing lists and the like.

  • You have the right to lodge a complaint with a supervisory authority that has jurisdiction over issues related to the General Data Protection Regulation.

  • We require only the information that is reasonably required to enter into a contract with you. We will not require you to provide consent for any unnecessary processing as a condition of entering into a contract with us by way of downloading a lead magnet, webinar, freebie or any other traditional list building methods.

We reserve the right to modify this Privacy Policy at any time. You acknowledge and agree that it is your responsibility to review this Site and this Policy periodically and to be aware of any modifications. We will notify you of any changes to this privacy policy by posting those changes on this page. Changes and clarifications take effect immediately upon posting on the website.

RECOVERY OF LITIGATION EXPENSES

If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable attorney’s fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.
